Aryosense terms of use

Aryosense is a social gaming and game-creation platform.

Through Aryosense, users can:

• discover and play a range of games and experiences;
• connect with other users;
• customise their avatar;
• use virtual items and features;
• find the games and experiences they enjoy;
• and use the platform's other features.

Aryosense also provides creators with tools such as Aryosense Studio so that they can create, manage and publish their own games and experiences.

In these terms:

• "Aryosense" means the website, the application, Aryosense Studio and the other services and infrastructure offered under the Aryosense name.
• "User" means any person who accesses Aryosense or uses its services.
• "Creator" means a user who uses Aryosense tools to create, manage or publish a game, experience or other content.
• "Experience" or "game" means interactive content that can be run on Aryosense.
• "User content" includes games, experiences, text, messages, models, files, profile information and any other content created, submitted or published by users.
• "Virtual content" includes avatars, avatar items, in-game items, virtual currency and the other digital assets or features available on Aryosense.
• "AryoCoin" is the virtual currency used on Aryosense.

By creating an account, signing in, using the application, playing games, using Aryosense Studio or using any of the Aryosense services, you accept these terms.

Some features may have their own rules or terms. In that case, the specific rules for that feature apply in addition to these terms.

The Aryosense privacy policy and Community Standards also form part of the framework for using the services.

Aryosense must be used in accordance with the applicable laws and regulations of the Islamic Republic of Iran, the rights of others, public order and the rules published by Aryosense.

The Aryosense services may not be used to carry out or facilitate unlawful activity.

Where the use of part of the Aryosense services is subject to a legal restriction or requirement in a particular situation, it is also the user's responsibility to comply with that requirement.

An account is required to use some Aryosense features.

Creating or using an account may require information such as:

• a mobile phone number;
• a username;
• a display name;
• other information needed to provide or manage the account.

Each account is created for the use of its owner alone.

The user is responsible for the activity carried out through their account, unless they can show that the activity was carried out without their permission and that they did not fail to protect the account.

Signing in and verifying a mobile phone number on Aryosense is done using a one-time password (OTP).

A one-time password is confidential account information. The user must not:

• give their OTP to anyone else;
• request or use an OTP belonging to someone else;
• attempt to gain unauthorised access to another person's account;
• misuse the OTP delivery or verification system.

To prevent abuse, Aryosense may apply limits such as capping the number of OTP requests.

Aryosense staff must never ask users to share their OTP with them.

The user is responsible for taking reasonable care to protect their account.

If the user notices any of the following, they must report it to Aryosense as soon as possible through the official contact channels:

• a suspicious sign-in;
• unauthorised use of the account;
• unexpected changes;
• activity that was not carried out by the account owner.

If Aryosense detects suspicious activity, it may, to protect the account or other users:

• temporarily restrict sign-in;
• end active sessions;
• ask for the phone number to be verified again;
• or apply other security measures.

Users may have a username or display name, subject to the features Aryosense provides.

A username or display name must not:

• contain insults or inappropriate language;
• infringe the rights of others;
• misleadingly impersonate another person or organisation;
• include information whose publication is against the law or the Aryosense standards;
• be used to defraud or mislead users.

Aryosense may change, restrict or remove names that break the rules.

Holding a username does not create a permanent ownership right over that name.

Users may use the services only within the scope of these terms and the features Aryosense has made available to them.

Any use that disrupts the security, performance or experience of other users is prohibited.

Users must not use Aryosense to:

• harass, threaten or pester others;
• bully or humiliate users;
• publish unlawful content;
• publish content that breaches the law or the Aryosense standards;
• spread hatred or insult individuals or groups;
• impersonate people or organisations;
• defraud or deceive users;
• carry out phishing;
• request users' OTPs or sign-in details;
• publish other people's private information without permission;
• distribute malware or malicious code;
• attempt to gain unauthorised access to Aryosense accounts, servers, APIs or infrastructure;
• attempt to bypass security mechanisms;
• deliberately disrupt the services;
• carry out attacks against the Aryosense infrastructure;
• tamper with internal systems;
• carry out any activity that infringes the intellectual property rights of others.

Further details of prohibited conduct and content may be set out in the Aryosense Community Standards.

Using methods or tools that alter the normal operation of a game or the platform, or that create an unfair advantage, is prohibited. This includes:

• Cheats;
• Exploits;
• Injection;
• tampering with the client or game communications;
• unauthorised modification of game data;
• using malicious software;
• using methods to bypass security restrictions;
• manipulating scores, rankings or in-game resources.

Aryosense may investigate suspicious activity and, where a breach is established, take the necessary action.

Using bots, scripts, crawlers or other automated methods to access the Aryosense services is not permitted unless Aryosense has given official permission.

In particular, users must not use automated tools to:

• create large numbers of accounts;
• send bulk requests;
• extract users' information;
• extract platform content;
• place abnormal load on the servers;
• manipulate statistics;
• manipulate scores or the game economy;
• abuse OTPs;
• or bypass service limits.

Aryosense may offer features such as:

• friends;
• game invitations;
• chat;
• message replies;
• user status display;
• and other social features.

When using these features, users must comply with the Community Standards and these terms.

Social features may not be used to threaten, harass, deceive, spam, defraud or share prohibited content.

Users are responsible for the messages and content they send through the Aryosense communication features.

Sending the following is prohibited:

• unlawful content;
• threatening messages;
• harassment or insults;
• content prohibited under the Community Standards;
• spam;
• unauthorised advertising;
• malicious links;
• OTP requests;
• attempts to steal accounts;
• another person's private information without permission.

Where a report of a breach is received or suspicious activity exists, Aryosense may review the relevant information and take the necessary action.

If a user sees content that they believe breaches the law or the Aryosense standards, they may use the reporting features or the official contact channels.

Reports may be reviewed to decide on measures such as:

• removing content;
• restricting content;
• warning the user;
• restricting certain features;
• suspending the account;
• blocking the account;
• other appropriate action.

Submitting a false or misleading report, or a report intended to harass another user, may itself be treated as a breach of these terms.

Aryosense may review content on the platform in order to enforce these terms and the Community Standards.

This review may take place:

• after content is published;
• after a report is received;
• after suspicious activity is detected;
• or as part of the platform's routine checks.

The presence of content on Aryosense does not mean Aryosense has permanently approved it.

Aryosense may restrict or remove content that is found to breach the law, these terms or the Community Standards.

If these terms or other Aryosense policies are breached, depending on the severity and history of the breach, measures such as the following may be taken:

• a warning;
• removal of content;
• restriction of certain features;
• restriction of communication with other users;
• temporary suspension of the account;
• blocking of the account;
• deletion of the account;
• restriction of access to certain services.

Where the safety of users or the platform is at risk, immediate action may be taken.

Users and creators may create, upload or publish content in parts of Aryosense.

User content may include:

• games and experiences;
• models and game assets;
• text;
• game names and descriptions;
• profile information;
• messages;
• other content created by the user.

Ownership rights in content created by a user remain, in principle, with the user or the lawful owner of that content.

For Aryosense to host, run and make user content available to other users, it needs a limited licence to use that content.

By uploading or publishing content on Aryosense, you grant Aryosense a non-exclusive, royalty-free licence, limited to purposes connected with the Aryosense services, to the extent necessary to:

• store the content;
• host it;
• process it technically;
• display it;
• run it;
• make it available to users;
• adapt it for different devices and formats;
• back it up;
• use it to promote that content or the Aryosense services.

This licence does not transfer ownership of your content to Aryosense.

By publishing content on Aryosense, you confirm that:

• you have the right to use and publish it;
• the content does not infringe the rights of others;
• the content is not against the law;
• the content does not breach the Aryosense Community Standards;
• where you have used content belonging to others, you have obtained the necessary permission.

Primary responsibility for the content a user or creator publishes lies with that user or creator.

Unauthorised use of items such as the following may infringe the intellectual property rights of their owners:

• games;
• characters;
• images;
• 3D models;
• music;
• audio;
• logos;
• brand names;
• code;
• artwork;
• or other works belonging to others.

Creators must make sure they hold the necessary rights or licences before publishing content.

If a person or rights holder believes that content published on Aryosense infringes their intellectual property rights, they may report it through the official contact channels.

Information or evidence such as the following may be requested in order to review the report:

• details of the work;
• the location of the disputed content;
• an explanation of ownership or the right to use;
• contact details;
• relevant documents.

Where an infringement is confirmed, Aryosense may restrict or remove the content concerned.

Aryosense Studio is a set of tools for creating and managing games and experiences that can be published on Aryosense.

Use of Aryosense Studio is subject to these terms and the other rules that apply to creators.

Aryosense may:

• update the Studio tools;
• change APIs or features;
• add new features;
• remove or replace older features.

Creators are responsible for the games, experiences and content they publish through their account.

A creator must make sure that their experience:

• does not breach the laws of the country;
• complies with the Aryosense Community Standards;
• does not infringe the rights of third parties;
• does not contain malware or malicious code;
• is not designed to gain unauthorised access to users' information;
• does not mislead users about the nature of the experience;
• does not abuse the Aryosense systems.

Publishing a game on Aryosense does not guarantee that it will remain published permanently.

Before or after publication, Aryosense may review an experience from the following points of view:

• technical;
• security;
• content;
• legal;
• or compliance with platform standards.

Aryosense may prevent an experience from being published, or restrict or remove a published experience, if it finds that it is not compatible with the law or the Aryosense standards.

Creators may change their experiences over time.

As a result, a game or experience that a user has used at one point in time may in future:

• change;
• gain new features;
• lose some of its features;
• or no longer be available.

Aryosense does not guarantee that any particular version of an experience will remain available forever.

The rights in the parts of the services created by Aryosense belong to Aryosense or the relevant rights holders.

These may include:

• the Aryosense name;
• the logo;
• the visual identity;
• the Aryosense software;
• Aryosense Studio;
• the user interface design;
• proprietary code;
• technologies;
• software architecture;
• content produced by Aryosense;
• trade marks.

Using the services does not transfer ownership of any of these to the user.

Without permission, users and creators must not:

• present themselves as official representatives of Aryosense;
• use the Aryosense logo in a way that causes confusion;
• present a product or service as an official Aryosense product;
• use the Aryosense visual identity to pass off a fake official service.

Permitted uses may be described in future in the Aryosense brand guidelines.

To the extent permitted by law, users must not, without Aryosense's permission:

• reverse engineer the Aryosense software;
• bypass its security mechanisms;
• tamper with the service's code or communications in order to abuse it;
• extract or reproduce parts of the service in order to build an unauthorised service.

This restriction does not prevent uses that are expressly permitted by law.

Aryosense may offer a virtual currency called AryoCoin.

AryoCoin:

• is not an official currency or legal tender;
• is not a bank account;
• is not an investment instrument;
• does not earn interest;
• has no guaranteed value outside Aryosense.

AryoCoin can be used only within the features that Aryosense provides.

Where it is possible to buy or receive AryoCoin, the amount of AryoCoin, the price or the conditions for receiving it are shown to the user before the transaction is completed.

An AryoCoin balance is linked to the user's account.

Aryosense may review the relevant transaction in cases of:

• fraud;
• invalid payment;
• abuse;
• technical error;
• duplicate transactions;
• or a breach of these terms.

Buying, selling, transferring or exchanging AryoCoin outside the methods officially provided by Aryosense is not permitted.

Users must not:

• sell AryoCoin outside Aryosense;
• transfer an account holding AryoCoin for the purpose of selling the AryoCoin;
• use unofficial marketplaces to exchange AryoCoin;
• use AryoCoin for fraud or money laundering.

Aryosense may offer virtual items such as:

• avatar items;
• in-game features;
• digital content;
• other virtual assets.

Buying or receiving virtual content does not transfer ownership of a physical asset or create ownership outside the Aryosense framework.

The user receives a limited right to use that content in accordance with the platform terms.

The nature of an online platform may require certain features or virtual content to change.

Where necessary, virtual content may be:

• updated;
• changed;
• replaced;
• or, in particular cases, withdrawn.

Where such a change has a material effect on users' purchases, Aryosense will act in accordance with the applicable law and the published terms.

Some Aryosense features or content may require payment.

Before a purchase is completed, the key details of the transaction, such as the price and what is being bought, are shown to the user.

Payment may be made through:

• a payment gateway;
• an app store;
• or other payment methods that Aryosense provides.

Using a payment provider may also be subject to that provider's terms.

The user must check the purchase details before confirming payment.

Transactions carried out through the user's account may be attributed to that account, except where unauthorised access is established.

If the user notices a suspicious purchase or transaction, they must inform support as soon as possible.

Refunds, cancellations and corrections of transactions are handled on the basis of:

• the type of product or service;
• the delivery status of the content;
• the payment method;
• the payment provider's rules;
• and the applicable laws of the Islamic Republic of Iran.

Information such as the transaction ID may be requested in order to review a refund request.

Aryosense may review suspicious requests, or requests where there is a possibility that the refund system is being abused.

If any of the following occurs, Aryosense may review the transaction records and correct them where necessary:

• technical error;
• incorrect allocation of AryoCoin or items;
• duplicate transactions;
• invalid transactions;
• fraud;
• abuse of the payment system.

Any correction must be made in accordance with the applicable law.

Some Aryosense services may include links, gateways or connections to third-party services. For example:

• payment gateways;
• app stores;
• external websites.

Use of those services may be subject to the terms and policies of the relevant provider.

Aryosense is not responsible for the operation of an independent service that is outside its control.

Aryosense may use methods such as the following for notices relating to the services:

• in-app notifications;
• the website;
• SMS;
• in-account messages;
• or other appropriate means of communication.

These notices may cover matters such as:

• security issues;
• significant changes to the services;
• account status;
• transactions;
• changes to the terms of use.

Aryosense is a service under active development. Over time:

• new features may be added;
• existing features may change;
• the user interface may change;
• certain limits may change;
• a feature may be removed or replaced;
• part of the service may be temporarily paused.

Using the services does not guarantee that all existing features will remain unchanged.

Continued use of some services may require a new version of the application or other Aryosense software to be installed.

Older versions may stop being supported after a period of time.

These changes may be necessary for:

• security;
• bug fixes;
• compatibility;
• the addition of new features;
• or performance improvements.

Aryosense aims to provide the services with a reasonable level of stability, but uninterrupted or error-free provision cannot be guaranteed in all circumstances.

The services may be temporarily restricted or unavailable for reasons such as:

• maintenance;
• updates;
• software errors;
• infrastructure failures;
• internet outages;
• security attacks;
• problems with third-party providers;
• events beyond Aryosense's reasonable control.

Some new features may first be made available to users on a trial basis.

A beta feature may:

• contain errors;
• change;
• be restricted;
• or be discontinued without becoming a permanent feature.

Where a significant feature is in beta, Aryosense may inform users of this.

Users may request deletion of their account through the features available on Aryosense or through support.

To prevent unauthorised deletion, ownership of the account may be verified before it is deleted.

The consequences of deleting an account may include losing access to items such as:

• the profile;
• friends;
• AryoCoin;
• virtual items;
• game data;
• projects;
• or other information linked to the account.

How information is retained after an account is deleted is explained in the privacy policy.

Aryosense may restrict a user's access, or suspend or block an account, in circumstances such as:

• a breach of these terms;
• a breach of the Community Standards;
• fraud;
• abuse of the services;
• a threat to the safety of users;
• a threat to the security of the infrastructure;
• unlawful activity;
• repeated breaches of the rules;
• a legal requirement.

The severity of the action may be determined by the nature and severity of the breach.

If an account is suspended or blocked, the user may lose access to all or part of the following:

• the account;
• AryoCoin;
• virtual items;
• published games and experiences;
• projects;
• social features;
• other features linked to the account.

Where the law requires otherwise, the law will be followed.

Where a review process is available, the user may request a review of certain actions relating to their account or content.

Information such as the following may be requested in order to handle the request:

• the user ID;
• an explanation of the matter;
• information about the decision;
• relevant documents.

Submitting a request for review does not guarantee that the earlier decision will be changed.

If Aryosense does not act immediately in response to a breach, this does not mean that the conduct is permitted or that Aryosense waives its right to take action in future.

Aryosense may act at an appropriate time once a breach has been identified.

A significant proportion of the games and experiences on Aryosense may be created by independent creators.

The presence of an experience on Aryosense does not mean that all of its content was created by Aryosense.

The creator is responsible for the content they publish. However, Aryosense may review, restrict or remove that content in order to enforce its rules and standards.

Aryosense aims to provide a suitable environment for users, but it cannot guarantee the accuracy, quality or suitability of all user content at all times.

If content breaches the law or the Aryosense standards, users may report it.

Aryosense aims to provide services that are secure, stable and usable.

However, to the extent permitted by law, Aryosense is not liable for loss that does not directly result from a legal breach or fault on the part of Aryosense, including loss arising from:

• the user's internet connection failing;
• problems with the user's device;
• third-party software;
• unauthorised use of an account because the user disclosed their OTP;
• content published by users or creators;
• independent third-party services;
• factors beyond Aryosense's reasonable control.

Nothing in these terms takes away from users any rights that cannot be waived or limited under the applicable law.

If a user's activity causes loss to Aryosense or to others, and the user is responsible for it under the law, the user may be liable to compensate for that loss.

This may include loss arising from:

• fraud;
• attacks on the infrastructure;
• intellectual property infringement;
• publication of unlawful content;
• unauthorised access;
• other legal breaches.

On receiving a valid request or order from a competent legal or judicial authority, Aryosense may cooperate in accordance with the applicable law.

This cooperation may include providing information that is required by law.

How users' information is handled in such circumstances is also explained in the privacy policy.

These terms may be updated over time for reasons such as:

• development of the services;
• the addition of features;
• changes to the service model;
• security requirements;
• or changes in the law.

The date of the most recent update is shown at the top of this document.

Where a significant change is made, Aryosense may give notice through the website, the application, the user's account or other appropriate means.

Using the services after a new version takes effect is, to the extent permitted by law, subject to the updated terms.

If part of these terms is found by a competent authority to be unenforceable or invalid, the remaining parts of the terms remain valid, unless they cannot be applied without the part concerned.

The user may not transfer their rights or obligations under these terms to another person without Aryosense's permission.

In the event of a restructuring, merger, transfer of the business or transfer of the services, Aryosense may transfer the rights and obligations under these terms to the successor entity in accordance with the applicable law.

These terms are interpreted and applied in accordance with the applicable laws and regulations of the Islamic Republic of Iran.

If a dispute arises between a user and Aryosense, we recommend raising the matter first through Aryosense support so that it can be reviewed and resolved.

If the dispute is not resolved in this way, either party may pursue the matter through the competent authorities in accordance with the applicable law.

In addition to this document, use of Aryosense may also be subject to other documents, including:

• the privacy policy;
• the Community Standards;
• the specific rules for creators;
• the terms of specific features offered in future.

Where specific terms exist for a particular feature, the specific terms for that feature apply alongside this document.
